3.2 AI and Data Processing

Our AI systems process project data to provide intelligent insights, automation suggestions, and performance analytics. By using PerfoNew, you consent to this processing for the purpose of enhancing your project management capabilities. We do not use your data to train AI models for other customers or third parties.

4.1 Platform Availability

PerfoNew strives to maintain 99.9% uptime for our AI project management platform. We provide redundant infrastructure, automated monitoring, and rapid response protocols to minimize service interruptions. However, we cannot guarantee uninterrupted service due to factors beyond our control, including internet connectivity issues, third-party service dependencies, or force majeure events.

We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our AI systems will be error-free, uninterrupted, or meet all your specific project management needs.

5.2 Limitation of Liability

In no event shall Perfo be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our platform. Our total liability for any claim shall not exceed the amount paid by you for our services in the twelve months preceding the claim.

Some jurisdictions do not allow limitations on implied warranties or liability for consequential damages, so these limitations may not apply to you in their entirety.
